Federal lawsuit could affect Rosemont project

On October 20, 2009, a coalition of national, regional, and local conservation and Native American organizations filed a lawsuit in federal district in Washington, D.C. against the U.S. Departments of Interior and Agriculture. The lawsuit challenges regulations issued by the George W. Bush Adminsitration that weakened the requirements for environmental and taxpayer protections in federal public land and mining laws. In regulations issued in 2003 and 2008, the Bush Adminsitration reversed a series of legal rulings issued by the federal courts and the Clinton Administration that had: (1) limited the amount of land available to mining companies operating on public land for the dumping of mine waste and other harmful practices (known as the "Millsite Rule"); and (2) required the payment of "fair market value" for the use of public lands not covered by valid and perfected mining claims.
These new rules, which have not been overturned by the Obama Adminsitration, have been and are being, applied by the agencies as grounds for mining companies to assert a "right to mine" and a "right to dump waste" on public lands -- in violation of longstanding federal laws, policies, and court rulings. Some of the proposed mining projects asserting these "rights" under the regulations challenged in the case include the Rosemont Copper Project south of Tucson, Arizona, and the Mt. Emmons Mine outside of Crested Butte, Colorado, as well as other mines that threaten water and air quality, wildlife, and Native American traditional and cultural practices across the West, among other impacts .

Rosemont Copper Mine Reclamation Plan
Arizona Geology: Rosemont copper mine reclamation plan now available

The Rosemont Copper Mine Reclamation Plan is now available for public viewing at the AZGS offices in Tucson. The Plan was submitted to the Arizona State Mine Inspector in Phoenix, which is the agency responsible to reviews and approve it. They are seeking public comment on the plan.
